Terms of Service

1. Agreement

By using Fish or Pass (operated by Set Sale Marine LLC), you agree to these Terms. If you don’t agree, don’t use the service. Questions: hello@fishorpass.com.

2. The service is a conditions report card

Fish or Pass provides a “Bite Score” — an informational read on fishing conditions. It is not a guarantee of results, not “odds,” and not a safety or navigation tool. Always check official NOAA forecasts, use your own seamanship, and follow current CDFW regulations and Marine Protected Area rules. See our score disclaimer. You fish at your own risk.

3. Accounts

You’re responsible for your account and for keeping your password secure. Provide accurate information and let us know of any unauthorised use.

4. Subscriptions & billing

Paid plans (Angler, Captain, Fleet) are billed through Stripe on a recurring basis until cancelled. The 7-day free trial does not ask for a card up front: if no payment method has been added by the time it ends, the trial simply stops and you are not charged. Add a card during the trial and the plan begins at the end of it. You can cancel anytime; access continues through the period you have paid for. Fees are as shown at signup and may change with notice.

5. Acceptable use

Don’t misuse the service: no scraping, reverse-engineering, reselling, or attempting to disrupt or gain unauthorised access. Don’t use it for anything unlawful.

6. Intellectual property

The service, the Bite Score model and outputs, content, and branding are owned by us or our licensors. We grant you a limited, personal, non-transferable licence to use the service; you keep rights to content you submit.

7. Disclaimers

The service is provided “as is” and “as available”, without warranties of any kind, including accuracy, fitness for a particular purpose, or that fishing conditions or results will match the score.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for lost fuel, time, catch, or profits, arising from your use of (or inability to use) the service.

9. Governing law

These Terms are governed by the laws of the State of California, and disputes will be handled in the courts located in California, unless applicable law requires otherwise.

10. Changes

We may update these Terms. Continued use after changes means you accept them. We’ll post the new date here.
