Fish or Pass Affiliate Terms
The plain version: tell people you earn a commission, never promise fish, keep your code with your own audience, and we pay you monthly on what we actually collect.
Version 1. Effective October 14, 2026.
These terms are between you and Set Sale Marine LLC, doing business as Fish or Pass ("Fish or Pass," "we"). By checking the box on the application form, you agree to them.
1. Who can join
You must be at least 18 and live in the United States. We review every application and can approve or decline anyone, for any reason.
2. Your code
If approved, you get a personal promotion code. It is for your audience only. We can deactivate or replace your code at any time, for example if it shows up on a coupon site.
3. What you earn
Your commission rate and the discount your code gives customers are in your approval email. If you are on a founding rate, the end date is in that email too.
You earn commission only on payments we actually receive from new customers who use your code. You do not earn commission on:
- trials that never become a paid subscription
- your own purchases, or purchases by anyone in your household
- payments that are refunded or charged back
4. Changes to your rate
We can change commission rates and customer discounts by emailing you at least 30 days before the change takes effect. Changes apply only to sales after the effective date. We never reduce commission on a sale that already happened.
5. Getting paid
We pay monthly for commission earned in the prior month, after a 30-day hold so refunds can clear. If you are owed less than $25, it carries over to the next month. We pay by ACH or check.
Before your first payment you must send us a completed IRS Form W-9. No W-9, no payment. You are an independent contractor, not an employee, and you are responsible for your own taxes.
6. How you promote
- Disclose, every time. Any post, video, story or comment that includes your code or talks up Fish or Pass must clearly say you earn a commission (for example "#ad" or "I get paid if you use my code"). This is required by the FTC, not just us.
- No catch promises. Do not say or suggest that Fish or Pass guarantees fish, predicts catches with certainty, or gives "odds." Fish or Pass grades fishing conditions. It does not promise results. See our score disclaimer.
- No paid search on our name. Do not bid on "Fish or Pass," "fishorpass" or similar terms in Google, Bing or any other ad platform.
- No coupon or deal sites, no spam, and no posting your code where people are not your audience.
- Do not pretend to be us. Do not create accounts, pages or ads that look like they come from Fish or Pass. Use our logo only as we provide it.
If you break these rules, we can withhold commission on the sales involved and end your participation.
7. Ending it
Either of us can end this at any time by email. We will pay commission already earned on valid sales before the end date, unless we ended it because you broke these terms.
8. Changes to these terms
We may update these terms. We will post the new version here and email you. If you keep promoting after the new version takes effect, you accept it. For significant changes we may ask you to agree again.
9. The usual fine print
The program is provided as is. We are not liable for indirect or lost-profit damages, and our total liability to you is limited to the commission we owe you. These terms are governed by California law.
